CINCINNATI -- Police are trying to figure out how a 1-year-old boy fell out of a third-story window before dawn Sunday.
Police said the boy fell on the grass and appeared to be OK, News 5's Bina Roy reported. He was being treated at Children's Hospital.
The boy fell out of a stairwell window about 5 a.m. at an apartment complex in the 200 block of Dorchester Avenue in Mount Auburn.
Another youngster found him lying in the grass.
The boy's mother was not home at the time, and other adults in the building were asleep, Roy reported.
Police are investigating.

Crib against the (open or nonexistent) window, no screen, "he never climbed out of the crib before, didn't know he could", adults present even if they aren't the parents..........
I see a whole lot of bad decisions here, but without knowing more, I'm not sure I see criminal acts. People don't go to jail for being stupid, even if it threatens the life of a child.
Several years ago, out in the 'burbs, a family that lived across the street from a friend of mine lost their 3-year-old child. The stream that cut across their back yard was swollen, there were guests there for Thanksgiving, Mom was really busy with cooking and thought one of the guests was entertaining the 3-year-old. "She had never been able to open the latch on the back door by herself before" said the distraught and bereaved mother. There was no trial or criminal penalty in that event.
Update to this story: apparently the baby was THROWN out of the window.
An 11-year-old boy has been charged with felonious assault for allegedly tossing the baby to the ground.

Yep. He was thrown out the window. A co-worker of mine did the actual processing of the charge, but borught it to me to make sure that we could cite the kid to court and not make it a warrant to to arrest the selfish little bastard.
Oh, BTW, I have dealt with the mother of the one year old before when she has had to come get her other deliquents outta jail.

How could an 11 year old not know that it's a bad idea to throw anyone (especially a baby) out a 3rd story window?
And it's always the same thing too.
"My baby didn't do (insert crime here). The police are just harassing him b/c he's black" Blah, blah, blah.
The best one was when she said this to me and complained about white people as well, but was back up at 2020 three days later wanting us to lock her kid up b/c he was "out of control and not listening to her".
The things that make you go "Hmmm. Apple/tree syndrome anyone?"
Oh and this part of the article just kills me.

Remember you heard it here first. This case will never go to trial. When they go to court in 3 weeks, the public defender will ask for a competency hearing. When that comes back as being unable to stand trial, the prosecutor will ask for a 2nd one. That one will also come back as unable to stand trial and the case will be referred to Juvenile Court Services and nothing will happen to this kid.
GS, you're being too hard on the poor, disadvantaged 11 year old.
We all know that because you're white, you're rich and haven't a care in the world. And, you've never been awakened by a crying baby, so you just don't know what "frustrated" is.
